Court Gives Tavern at Tina's Owners Until Sept. 24 to Build Bypass Lane on North Avenue

A Macomb County Circuit Court judge has ordered the owners of and to build a southbound bypass lane opposite their property on North Avenue by Sept. 24 or face legal consequences, according to court documents.

Judge James Biernat, Jr. issued the order Wednesday morning following a status conference between the parties involved in the case of .

This conference was held to address a breach in the signed by owners of the Tina’s properties (TTCH Development) and Macomb Township following some three years of legal disputes. Per the consent judgment, Tina’s owners, sisters Cathy and Mary Jo Imbronone, had until June 1 to build a bypass lane on the west side of North Avenue.

When the deadline passed and the work was not completed, Macomb Township's legal counsel asked the court to hold TTCH Development in comtempt of court and costs. The judge agreed to give TTCH Development until Sept. 24 at 11 a.m. to engage a contractor to perform the work as described in plans approved by the Macomb County Department of Roads (i.e. a southbound bypass lane on North Avenue south of 23 Mile Road).

Should the bypass lane not be completed on or before Sept. 24, the judge ordered TTCH Development to immediately contact the court with an updated report.
