Court Orders Psychological Evaluation for Alleged Arsonist

The arson and domestic violence case against Macomb Township resident, Dujuan Edward Smith, 35, will continue pending the results of court-ordered evaluations.

The arson case against a 35-year-old Macomb Township man will take a brief hiatus pending the results of court-ordered psychological evaluations.

Dujuan Edward Smith, 35, is facing counts of arson and domestic violence stemming from allegations that on Feb. 1, at approximately 7:30 p.m., he set fire to the home at 45300 Card Road in Macomb Township.

41A District Court Judge Douglas P. Shepherd referred the case for competency and culpability on Tuesday. The case will stall pending the result of these psychological evaluations, which will examine Smith's mental state at the time of the alleged crime and determine whether he is fit to stand trial.

During Tuesday's hearing, Shepherd also denied Smith's attorney's request to modify his bond, which is currently set at $250,000 cash or surety.

On Feb. 1, at approximately 7:41 p.m., Macomb Township fire crews and sheriff's officers responded to a house fire at 45300 Card Road.

Macomb County Sheriff Anthony Wickersham said Smith admitted to police that he set the blaze following an altercation he had with the home's other tenant. Smith was arrested on Feb. 3 and arraigned on two counts of arson and one of domestic violence on Feb. 6.

Arson is a 20-year felony in Michigan. The second arson charge–preparation to burn–is a 10-year felony and/or $15,000 fine. The domestic violence charge is a 93-day misdemeanor.
